East Oak Estates Hoist Agreement

Due to DNR restrictions and guidelines, space on the Association Dock is limited. In an effort to make the sometimes difficult task of hoist placement easier for everyone involved, the Dock Committee has formulated the following procedures and guidelines in an effort to best accommodate for hoist space requests and placement.

HOIST SPACE IS A PRIVILEGE AND COMPLIANCE OF THE FOLLOWING MUST BE MAINTAINED

▪▪ The charge for hoist space for the 2024 season will be $450.00 per space. Boat lengths exceeding 28 feet require board approval. Both PWCs on a double hoist must be owned by the same person. Association dues must be paid at the same time hoist applications/fees are submitted plus any previous unpaid dues or fees. Association dues for 2024 are $550 per lot.

▪▪ Notice: You must include a copy of your boat/PWC registration with your application to verify that

vessel ownership matches EOE property ownership.

▪▪ We operate with a “GRANDFATHERED CLAUSE”, that is, once you have a hoist space on the dock, you have a spot every year thereafter, until you give up your space either voluntarily or involuntarily. Your hoist space location is not guaranteed. Your spot cannot be given, sold or rented to anyone else. Should you move, your spot is not included with the sale of your home.

▪▪ Grandfathered Hoist space requesters must submit the completed application, along with the appropriate fee by March 15, 2024. Any hoist space not paid for by this time will be considered open for reassignment and forfeited by the previous recipient.

▪▪ New Hoist space requesters must submit the completed application, along with the appropriate fee on or before March 15, 2024 and will be assigned on a first come first serve basis and is not guaranteed.

▪▪ It is not allowed to secure a hoist spot and not put in a hoist. All spots must occupy a hoist and a vessel.

▪▪ All requested hoist assignments will be made by the Dock Committee after March 15, 2024. Only

requests that are complete will be assigned. Final placement is contingent on DNR approval, current

water levels, efficient use of space, installer and other considerations.

▪▪ All hoists must be removed no later than October 10, 2024. Earlier removal may be required due to water levels. You will be notified in event earlier removal is required. Removal is at owners’ expense and arrangement. No hoist will be stored on the association property.

▪▪ To save on space, it may be necessary to limit the catwalks to every other hoist. You may be asked to share your catwalk with the neighboring hoists.

▪▪ Catwalk ownership, maintenance, installation, removal and storage are the responsibility of the hoist owner.

▪▪ Because of limited space on the Association Dock, hoist space is only available to owners of Lots #20 thru #68 of East Oak Estates. Homeowners receiving priority over lot owners.

▪▪ The above grandfather/priority system is applicable to one vessel per homeowner.

▪▪ Boats and other watercraft are not to be parked, permanently or temporarily, on the beach, or other areas of the common lot.

▪▪ Failure to comply with EOE Home Owners Association Covenants and Hoist Agreement will result in loss of dock and hoist privileges.

▪▪ All of the above is subject to change based on DNR requirements and restrictions, water levels and available space – availability is not guaranteed.

▪▪ If you have a second dock space, you may have to give up that space at ANY time throughout the season depending on availability. Should you have to give up the space, your fee for that space will be refunded.

▪▪ You are responsible for all costs associated with installing and removing your hoist. Do not place your hoist prior to receiving your approved CURRENT SEASON SPACE assignment. Misplaced hoists will be moved or removed at owner’s expense2
